New Executive Order Targets Equity Considerations in K-12 School Discipline

On April 23, 2025, President Donald J. Trump issued an Executive Order titled “Reinstating Common Sense School Discipline Policies,” rolling back Obama- and Biden-era initiatives aimed at reducing racial disparities in K–12 suspensions and expulsions. The Order criticizes previous policies for promoting race-based disciplinary standards and claims they encouraged schools to overlook student misconduct, compromising classroom safety. In response, the new directive replaces what it calls ‘unlawful equity ideology’ with a behavior-based approach to discipline. Set to take effect within 30 to 120 days, this Order is one of six education-related directives issued that day — including a separate Executive Order advancing AI literacy in schools.

Schools are advised to closely follow federal guidance to avoid compliance issues and potential funding loss.
