SMGG wins a 100% jury verdict in a consumer protection and breach of warranty case in a Pennsylvania federal court.
SMGG attorney Lydia Gorba sought, and won, $146,000 in compensation for clients Laura Catena and Gregory Novotny in their claim against home builder, Heartland Homes (NVR, Inc. t/d/b/a Heartland Homes of Pa.) Heartland Homes constructed a new home for Catena and Novotny pursuant to a 2017 contract, but when Catena and Novotny moved in, they discovered numerous problems in the home. Heartland Homes did not repair the issues. Some of Heartland Homes’ repair attempts failed and they completely refused to address other construction defects.
In early 2020, SMGG filed a lawsuit in the Western District on behalf of Catena and Novotny against Heartland Homes for breach of written warranties in their construction contract and violation of Pennsylvania’s Unfair Trade Practices and Consumer Protection Law. For two and a half years, the SMGG team resisted multiple attempts by Heartland Homes to have the case dismissed, and ultimately won every penny that the plaintiffs sought in compensation before a jury with the Honorable Marilyn J. Horan presiding.
