SMGG’s real estate attorneys have extensive experience in all aspects of leasing transactions including residential and commercial leases.  Working as a team, we represent both landlords and tenants, including developers, lenders, owners, investors, schools, non-profits and management companies.

Our leasing work includes all aspects of a lease transaction both complex and simple as follows:

  • Preparing letters of intent.
  • Drafting, review and negotiation of lease agreements.
  • Negotiating work letters, build-out agreements and other construction-related matters.
  • Coordinating subordination and non-disturbance agreements.
  • Advising on environmental concerns and compliance with governing regulations.
  • Analyzing the effect of existing easements and negotiating new easements and right of ways when necessary for use of the leased premises.
  • Negotiating maintenance obligations and shared charges.
  • Reviewing, preparing and negotiating options to purchase and land installment agreements.

Our attorneys can effectively manage complicated leasing situations, including ground leasing, subleases, lease assignments, sale/leaseback transactions and buy-outs.  We represent landlords and tenants in various types of leases, including, office (including build-to-suit), warehouse, industrial, retail (including restaurants and shopping centers), residential, apartments, vacation rentals, land installment contracts and lease-to-own agreements.  We assist clients with lease management, including landlord/tenant issues and enforcement of remedies.  Our real estate litigation team works very closely with our real estate transaction lawyers in connection with landlord/tenant issues and disputes that arise (see Landlord/Tenant information page for further information regarding lease enforcement and evictions).
