Easements/Rights of Way

Easements/Rights of Way

SMGG has decades of experience counseling and representing clients in complicated residential and commercial real estate matters, including dealing with rights and encumbrances.

Our Real Estate Group has years of experience drafting, reviewing, and negotiating the documents that affect the use and enjoyment of real property, such as licenses, covenants, easements, or rights-of-way. Whether you want to negotiate and formalize the terms of an easement or right of way affecting your property, are looking to dispute an easement, or require assistance asserting your rights under an existing easement, license, or right of way document, we will work to protect your interests.

An easement or right of way is a legal right to use your or another person’s property for a specific purpose. While most common easement arrangements generally include rights granted to utility companies to install and maintain service lines, there are many different situations which can involve easements and rights of way between neighboring landowners or other private parties. Almost all easements and rights of way involve a continuing relationship – often lasting forever – between owners of land. At SMGG, we understand the need for dedicated representation that must be balanced with a relationship that will likely continue long after we have helped our clients reach a resolution.
